信用原则，先履行方不仅不得中止履行，而且还应积极协助对方履行，防止损失的出现或扩大。例如，甲公司因市场行情突变，经营遇到暂时的困难，则乙银行不应中止原定的贷款协议，以帮助甲走出困境。
(三)完善不安抗辩权制度的立法建议
由于我国合同法的不安抗辩权制度同时吸收了大陆法不安抗辩权制度和英美法预期违约制度这两种本来就有很大差异的制度内容，并力求将两者调和，也导致了立法上的冲突和矛盾。具体如下：
第68条和第69条的规定与第94条的规定相矛盾。依据第94条，当事人以自己的行为表明不履行主要义务的，对方可以解除合同;而依据第68条和第69条的规定，对方当事人在此种情况下只是有条件地享有解除合同的权利?只能先中止履行，对方在合理期限内未恢复履行能力并且未提供适当担保时，方可解除合同?。因为应当履行债务的当事人转移财产、抽逃资金，以逃避债务的行为也属于以自己的行为表明不履行主要债务的行为。一定意义上，经营状况严重恶化和丧失商业信誉的情形也可以视为以自己的行为表明不履行主要债务。
不安抗辩权制度与预期违约制度，前文已做了比较，不再赘述。这里只谈谈自己对解决这一立法矛盾的看法。首先，由于我国法基本属于大陆法系，新合同法对完善抗辩权制度做了很大的工作，建立了完整的

抗辩权体系，因此，不应该轻言摈弃不安抗辩权制度。其次，应该对前述有冲突的条文做一修改，修改的方向，也应该首先考虑不安抗辩权制度，其次考虑吸收预期违约制度。因此，笔者不同意有学者关于删除不安抗辩权制度，而直接规定预期违约制度的修改建议。基于这两点，笔者提出如下修改意见：
第68条和第69条不做修改，第94条修改为：“有下列情况之一的，当事人可以解除合同：??(二)在履行期届满之前，当事人一方明确表示不履行主要债务;??”，增加一款作为第(三)款：“在履行期届满之前，当事人一方以自己的行为表明将不履行主要债务，另一方当事人可以中止履行，中止履行后，对方在合理期限内未恢复履行能力并且未提供适当担保的”。
