的担保。在主合同无效的情况下，前者因担保合同的无效而无效;后者由于明确了是对债务人因主合同无效而应承担的责任进行担保，故担保合同仍然有效，担保人仍须承担相应的责任。换言之，在主合同无效的情况下，主合同债权人与债务人之间的债权债务关系已转变为围绕对主合同无效应负的责任展开，此时若存在债务人应履行的债务，则应为债务人因主合同无效而应承担的责任。因此，对主合同与担保合同之间的效力关系“另有约定”，只能是担保人与债权人就是否对债务人因主合同无效而产生的责任承担担保责任进行约定。也只有在这种约定的情况下，担保合同的效力才具有独立性，可以不因主合同的无效而无效。因为，此时的担保合同所针对的恰恰是主合同无效后的担保责任，对其法律效力的认定自然不受主合同无效的影响。从这个意义上讲，简单地规定担保合同具有独立性，但未明确在主合同无效的情况下，担保人对债务人因主合同无效而产生的责任承担担保责任，则在我国现有担保法律下，应当认定为无效。因为在通常情况下(除非上述提到的明确约定才使得担保合同具有独立性)，担保合同是一种从合同，它以主合同的存在和生效为前提，主合同不成立，从合同就不能有效成立。
基于以上分析，我认为，由于丙企业仅与甲企业约定“担保合同的效力独立于被担保的借款合同。借款合同无效并不影响本合同的效力”，而未明确约定担保人对债务人因主合同无效而产生的责任承担担保责任，故这种约定是无效的，丙企业与甲企业之间的担保合同，因主合同的无效而无效，至于丙企业的责任，则根据担保法司法解释第八条的规定，

视丙企业有否过错，承担相应的民事责任。反之，如果本案中担保合同规定了担保人对债务人因主合同无效而产生的责任承担担保责任，则不论丙企业有否过错，均应依照此约定承担担保责任，换言之，此时担保法司法解释第八条不再适用。
