行政复议机构论文：我国行政复议机构的现状、问题及对策研究
【中文摘要】现代社会利益关系急剧分化,矛盾和纠纷增加是不可避免的,因此没有完善的纠纷解决机制必定影响社会的和谐的实现。目前主要的行政纠纷解决机制有行政诉讼、行政复议、行政调解以及信访等形式。作为公民权利救济和行政纠纷化解的一种重要机制---行政复议制度在我国的建立将近十年,2007《行政复议法实施条例》的生效实施,使我国现行的复议制度得以进一步完善。但是,行政复议制在实践中也暴露出一些不足。如行政复议案件维持率偏高,偏高的维持率使得行政复议制度本身的公正性受到质疑,使得公众转而求助于诉讼和信访。近年,行政诉讼案件明显增长,同时,全国各地信访案件数量也呈上升趋势,而其中相当一部分信访案件都属于行政复议的受理范围。公众宁愿选择诉讼和信访,而不愿选择既经济又快捷的行政复议,暴露出行政复议制度本身还存在着问题。基于它本身的优势与实践中存在的问题,行政复议制度亟待进一步改革完善。而最重要的改革莫过于行政复议机构的改革。一般认为,行政复议机关是具有独立行政主体资格的行政机关,能以自己的名义独立行使职权并承担相应的法律后果;而行政复议机构是行政复议机关内部具体负责复议工作的办事机构,不具有独立的行政主体地位,依附于行政机关,必须以复议机关的名义行使职权,复议决定只能以复议机关的名义做出。我国的行政复议法规定了这两个紧密联系又不尽相同的概念,使
得实践中行政复议权不够明确,行政复议机构在行政复议制度中的作用难以发挥,而缺乏独立性的行政复议机构要以公正的身份裁决纠纷,难以做到真正的公正,这也成为当前行政复议制度实践中最大的忧患。实践证明,纠纷解决的公正性与纠纷解决机构自身的独立性和权威性是密切相关的。由行政复议机关内部负责法制工作的机构处理复议案件无法保障复议结果的公正性。所以,行政复议机构设置是否科学,直接决定了行政复议制度能否产生良好的社会效果。因此,进一步完善行政复议机构的理论研究与实践,已成为当务之急。本文主要包括四部分,第一部分阐述基本概念和基本理论,主要是剖析主要概念的内涵和外延;第二部分介绍我国行政复议机构的设置以及缺陷,该部分主要是发现问题;第三部分详细介绍了国外行政复议机构,和它们的经验教训;最后是完善我国行政复议机构的思考和探索。
