摘要
行政职权滥用作为一种社会历史现象，特别是进入世纪年代以来，行政职权滥用已成为全世界关注的焦点问题。它直接关系到国家政权的稳定，威胁到国家的生死存亡，妨碍着行政管理的现代化进程，障碍着经济的健康发展，导致社会风气的败坏，诱发更多的犯罪行为。现阶段，我国正处在由计划经济向市场经济转轨的历史时期，由此产生的负面作用和相关因素的影响，引发了职务犯罪范围扩大、案值剧增、层级升高、窝案串案频发的严重态势。要加强和改进对领导权力下放的监督制约机制，充分认识行政职权滥用的危害性，健全适合我国国情的权力监督制约机制，加大行政权力的监督制约力度，确保权力的规范运行。基于此，本课题通过探讨如何有效的杜绝行政职权滥用的状况，进而改进和完善行政权力的监督制约机制，真正实现依法治国。

Abstract
Abuse as a social and historical phenomenon, enter especially since 1990s, the abuse of power has become the focus of attention of the world problem.It is directly related to the stability of the national political power, a threat to the country's of vital importance, prevent administrative modernization process, obstacles to the healthy development of the economy, lead to the corruption of social atmosphere, induced more criminal behavior.At this stage, China is in the transition from planned economy to market economy period, the resulting negative effect and related factors, triggered the crime scope, value increase, hierarchy, elevated nest case series case serious situation.To strengthen and improve the leadership of devolution of power supervision and restriction mechanism, to fully understand the harm of misuse of administrative authority, perfect to fit our country national condition of power supervision and restriction mechanism of administrative power, increase supervisory strength, ensure the operation of power.Based on this, this paper discusses how to effectively put an end to the administrative authority abuse status, and further improve and perfect the mechanism of supervision and restriction of administrative power, the true realization of rule by law.
